1 License
XHTMLSuite.com grants you a non-exclusive, non-transferable license issued by XHTMLSuite.com to install and to use the software.
The Software holds an encrypted file which will be locked to a Domain name respectively an IP address you specify.
This means that for each Domain or IP address you want to install the Software on, you need to purchase a separate license. This applies to Domain Licenses and Server Licenses.
License files, once generated and delivered or downloaded by you, cannot be transferred to another Domain or IP address.
2 Acceptation and Cancellation of Contract
XHTMLSuite.com accepts orders according to the conditions published on this website and in particular only to the prices given here.
XHTMLSuite.com is entitled to cancel any orders based on misprints and on account of errors made on this website.
Acceptation of the order by XHTMLSuite.com is fulfilled by shipping the Software by e-mail or by seding you a download link by e-mail after your successful payment.
3 Shipping/Delivery
After we have received your payment you will receive a confirmation e-mail which will contain download links to the Software Product(s) and appropriate License Key(s) you have purchased.
If the Software is not directly downloadable, it will be sent to the e-mail address you have provided upon purchase or to any other e-mail address arranged with you, within two (2) business days after your payment is received.
Alternatively, if delivery by e-mail fails, a download link will be sent to your e-mail address within two (2) business days after your payment is received.
4 Interoperability
XHTMLSuite.com has no influence on the development of Joomla! and Mambo.
The Software you purchase is always designed for the announced version of Elxis, Joomla! or Mambo (i. e. XHTMLSuite for Joomla! 1.0.x or or Joomla! 1.5 or Elxis2006 or Mambo 4.5.x).
XHTMLSuite.com can give no guarantee, that the Software will run failsafe or run at all with future versions of the aforementioned CMSs.
5 Updates
From time to time, XHTMLSuite.com may make available updates to the Software.
These updates are provided to you for download free of charge within 90 days after you have purchased the Software.
All updates to the Software are governed by the license agreement you have accepted upon download/purchase, unless other license terms are provided with the update. A claim for updates cannot be raised.
6 Support
Based on the information you provide upon purchase, a customer account will be created for you on our website, which will give you access to the our support system for 90 days after you have purchased the Software. Your customer account will be fully activated after we have received your payment.
You may subscribe to one of our affordable Premium Support Plans after the free support has expired.
7 Privacy
All customer data collected from orders will be exclusively used for the purpose of order transaction and will not be transferred to third parties.
The customer agrees to evaluation, processing and use of such customer related data for the above purpose.
8 Place of Fulfillment and Jurisdiction
Place of fulfillment for delivery and payment is Hamburg/Germany.
Place of jurisdiction is Hamburg/Germany.
9 Return and Exchange
XHTMLSuite.com offers non-material, non-tangible irrevocable goods (software), which, once delivered or downloaded by you, cannot be returned, which you are responsible for understanding prior purchasing.
Our website features comprehensive live demos and/or Flash™ movies to help you understand how the product performs. Clients are encouraged to take a close look at all features presented prior to purchasing, in order to have a good idea about the product capabilities.
Once you have downloaded the Software and/or the Software was sent to you by e-mail, refunds cannot be given.
We may make exceptions of this rule at our sole discretion on a case by case basis. The deadline for any refund claim is one week after the delivery date.
10 Severability
In the event of invalidity of any provision of these terms and conditions, the validity of the remaining portions shall not be affected.
